Booking Terms and Conditions

1. Parties and service model

The customer contracts through Tenerife Rent a Boat. Depending on the product, the operating service is supplied by Poseidon Rent a Boat or by an identified independent operator. Tenerife Rent a Boat may act as seller, booking agent or intermediary as stated in the booking flow.

The operating provider is responsible for the vessel, crew, safety briefing, legal operating requirements and delivery of the activity. Tenerife Rent a Boat remains responsible for its own booking and customer-support obligations.

2. Pre-contract information and acceptance

Before booking, review the activity description, provider, location, date and time, duration, participant rules, inclusions, exclusions, price, payment schedule and cancellation policy.

You must actively accept these Terms and acknowledge the Privacy Policy before the booking widget opens. The current versions, timestamp, language and a consent reference are sent with the widget request.

3. Booking formation

An instant-booking product becomes binding when the required payment is authorised and confirmation is issued. A request-to-book product remains pending until the operator accepts it and a confirmation is issued.

An acknowledgement that a request was received is not necessarily final confirmation. Do not make non-refundable travel arrangements until you receive confirmation.

4. Prices, taxes and payment

Prices are in euros and include taxes where applicable, unless the checkout clearly states otherwise. The activity page or checkout identifies what is included and any amount due later, such as balance, fuel, skipper, optional extras or refundable security deposit.

Payments may be collected by Tenerife Rent a Boat, BookingOS, a payment processor or the operating provider. Card authorisation may be subject to anti-fraud and authentication checks.

5. Security deposits and damage

Boat rentals may require a refundable deposit or card pre-authorisation at check-in. The amount and release conditions are shown for the product or communicated before departure.

The customer is responsible for loss or damage caused by misuse, negligence, prohibited navigation, breach of instructions or conduct of their group, subject to applicable law and the rental agreement. Ordinary wear and pre-existing damage are not chargeable.

6. Customer information and eligibility

You must provide accurate contact, participant and payment information and tell us promptly if it changes. The lead customer must be an adult with authority to accept these terms for the group.

Age, capacity, weight, swimming ability, pregnancy, health, accessibility and alcohol restrictions vary by activity. The provider may refuse participation where a published safety requirement is not met, without a refund where the failure is attributable to the customer.

7. Licences, identity and check-in

Bring the original identification, booking confirmation and any nautical licence required by the product. A licence must be valid for the vessel and navigation area and may be checked before departure.

Arrive at the stated meeting time. Late arrival may shorten the activity or be treated as a no-show if the operator cannot delay departure.

8. Safety and conduct

Follow all instructions from the skipper, guide and staff; wear required safety equipment; remain within authorised navigation areas; and do not operate a vessel under the influence of alcohol or drugs.

The operator may stop or refuse the activity where conduct creates a safety, legal or property risk. No refund is due where termination is caused by the customer’s serious breach.

9. Weather, sea conditions and operational changes

Marine activities depend on weather, sea state, port instructions, wildlife and safety. The operator decides whether conditions permit departure and may change route, speed, vessel, meeting point or timing when reasonably necessary.

A materially equivalent replacement does not automatically create a right to refund. If the provider cancels and no acceptable alternative is offered, amounts paid for the cancelled service will be refunded through the original payment channel.

10. Customer changes and cancellations

The cancellation and amendment rules displayed for the selected product apply. They may differ between boat rentals and third-party activities. A request is effective only when received through the stated contact channel and acknowledged.

Late cancellation, failure to appear, missing documents, invalid licence or refusal caused by a customer safety breach may be non-refundable according to the product conditions.

11. Statutory withdrawal

Leisure services booked for a specific date or period may fall within the legal exception to the general 14-day withdrawal right. Therefore, do not assume that a confirmed dated activity can be cancelled free of charge; the product cancellation policy applies, without limiting any mandatory right you may have.

12. Operator cancellation, refunds and chargebacks

Approved refunds are made to the original payment method where possible. Bank and card processing times are outside our control. A refund covers the cancelled service amount and not unrelated travel, accommodation or consequential costs unless mandatory law requires otherwise.

Before starting a chargeback, contact us so we can provide confirmation, cancellation or refund evidence and try to resolve the matter.

13. Personal belongings, photos and wildlife

Customers remain responsible for phones, cameras and personal items unless loss is caused by proven negligence of the responsible provider. Wildlife sightings cannot be guaranteed because animals are wild and routes remain subject to regulations and sea conditions.

Photos or videos for promotional use require an appropriate legal basis. Tell the crew if you do not wish to appear in optional group content.

14. Complaints and liability

Report operational problems immediately so the provider has a reasonable opportunity to address them. Formal complaints should include the booking reference, date, facts and supporting evidence and be sent to the legal email above.

Nothing excludes liability for fraud, wilful misconduct, personal injury caused by negligence or any consumer right that cannot be excluded. Liability for indirect losses is limited to the extent permitted by law.

15. Law, severability and language

Spanish law applies, subject to mandatory consumer protections. If one clause is invalid, the remainder continues to apply. Translations are provided for convenience; if wording differs, the Spanish version is the reference, without reducing rights granted by mandatory law.
